Bank Payment Obligation – новый инструмент межбанковских международных расчетов
В последнее время в банковском мире все больше говорят о BPO (Bank Payment Obligation). Это совершенно новый инструмент, который промотирует SWIFT и поддерживает ICC. Сейчас ICC совместно со SWIFT разрабатывает правила для BPO. BPO представляет собой безотзывное обязательство одного банка осуществить платеж в пользу другого банка при условии, что некоторое количество предварительно определенных условий успешно выполнено в электронной системе сопоставления данных внутри специальной IT платформы. Пока единственной такой действующей платформой является TSU (Trade Service Utility) SWIFT. Скорее всего, такие IT провайдеры как Misys, China Systems, CSI, MIT, Sopra, Supercomp будут также разрабатывать свои решения.
Инструмент современный, возразить здесь нечего, основанный на электронном сопоставлении данных. Но поскольку он совершенно новый, мало кто понимает, как и где его использовать. Создатели и разработчики BPO упорно утверждают, что он предназначен для расчетов по открытому счету. Банкиры с не меньшим упорством сравнивают его с документарным аккредитивом и противопоставляют одно другому.
Итак, два главных преимущества BPO – это «безбумажность» и как следствие «неручное сопоставление или проверка». Как они работают в указанных выше случаях? Здесь надо отметить, что BPO – межбанковский продукт, и любые правила будут регулировать взаимоотношения только банков между собой.
Если мы говорим о BPO как опции расчетов по открытому счету и инструменте финансирования открытого счета, то здесь и «безбумажность», и «электронность» очевидны. Вряд ли компания-продавец согласится представлять в банк бумажные документы для того, чтобы выделить из них данные, необходимые для сопоставления. Скорее всего, продавец передаст тем или иным способом в банк сами эти данные. Иначе зачем ему вообще связываться с этим продуктом?
В случае, если BPO рассматривается как замена аккредитиву, все не так однозначно. Да, между банками документы ходить не будут. Но станет ли безбумажным плечо «продавец-банк»? Ведь аккредитив, кроме всего прочего, покрывает риск того, что товар не будет отгружен, а доказательством отгрузки как раз является пока еще бумажный транспортный документ. Однако здесь, я думаю, электронные транспортные документы не заставят себя долго ждать….
